Cavs shooting guard J.R. Smith found himself in a bit of trouble with the law over the summer for throwing a fan’s cell phone into a construction site for trying to take his picture without permission. Now, though, it sounds like he and his attorney have struck a deal in the case.

According to a report from TMZ.com, Smith and his lawyer, Alex Spiro, appeared before a judge in a Manhattan courtroom Thursday morning, where his case was ultimately adjourned in contemplation of dismissal.

Smith, now 33 years of age, will have to buy the fan a new phone and stay out of trouble for six months, according to TMZ. If he can manage that, he’ll be in the clear.

Smith allegedly threw the fan’s phone after he tried to take his picture near The Park restaurant on 10th Avenue in New York City. “Swish,” as he’s come to be known, turned himself in to police in August and was issued a ticket for misdemeanor criminal mischief.

In his 10 appearances with the Cavs this season, Smith has racked up averages of 7.2 points on 34.7 percent shooting from the field (31.6 percent from beyond the arc), 2.1 assists, 1.8 rebounds and 1.1 steals in 21.6 minutes per outing.

Smith and the Cavs will be back in action on Monday night, when they’ll travel to Detroit for a match-up against the Pistons. Tip-off inside Little Caesars Arena is set for 7:00 p.m. EST with FOX Sports Ohio having live broadcast coverage.
